KKday AI Virtual Travel Assistant Terms of Service
Welcome to KKday's “AI Virtual Travel Assistant” (the “AI Assistant”). These Terms of Service (these “Terms”) govern your rights and obligations in connection with your use of the AI Assistant. By using the AI Assistant, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to all or any part of these Terms, please do not use the AI Assistant.
These Terms supplement the KKday Terms and Conditions. Where the User Terms are silent or conflict with these Terms, these Terms shall prevail with respect to the use of the AI Assistant; matters not provided for in these Terms shall be governed by the Terms and Conditions and the Privacy Policy. The collection, processing, and use of personal data in connection with the AI Assistant shall be handled in accordance with the Privacy Policy, which you should also read before using the AI Assistant.
Article 1 How the AI Assistant Works
1.1 The AI Assistant is available to KKday members and to visitors who are not logged in. Visitors who are not logged in may engage in only a limited number of conversations per session; the actual number of available conversations and the reset method shall be determined by KKday based on operational circumstances. To continue using the AI Assistant, please log in or register as a KKday member.
1.2 The AI Assistant is limited to general pre-purchase travel inquiries, such as itinerary suggestions and common travel information queries, and does not constitute the formation of an order, payment, or any other legally binding decision. Such matters must still be completed through the existing ordering process on the KKday website or App.
1.3 Certain services of the AI Assistant may be available only on specific versions of the website or App, and may be adjusted, expanded, or changed as technology develops.
1.4 The AI Assistant is available only to users aged 18 or older (or the age of full legal capacity under the laws of your jurisdiction, whichever is higher). This age restriction is stricter than the provision of the Terms and Conditions permitting minors to register as members with the consent of their legal representative, and shall prevail with respect to the AI Assistant. Even if you have lawfully registered as a KKday member, you may not use the AI Assistant if you are a minor. If KKday becomes aware of or reasonably suspects that a minor is using the AI Assistant, KKday may terminate your access to the AI Assistant without prior notice and, in the manner set forth in Article 7 of the Privacy Policy, delete or de-identify the personal data and conversation records you provided within the AI Assistant during your period of use. KKday may make such determination based on your registered member information or your representations, and shall not thereby be obligated to proactively check or verify the actual age of users. By using the AI Assistant, you represent and warrant that you meet the foregoing age requirement.
1.5 To maintain system stability and fair use among users, KKday may set reasonable limits on the number of uses, frequency of use, or length of a single input for any single account, device, or connection within a given period.
Article 2 Geographic Scope of Service and Usage Restrictions
2.1 KKday may restrict users in specific countries or regions from accessing the AI Assistant based on legal compliance, requirements of competent authorities, policies or technical limitations of third-party service providers, information security, or other operational considerations. KKday may use the user's network (IP) address or other reasonable technical means to identify users in such regions and restrict their access to the AI Assistant. Such adjustments shall not affect your right to use other KKday services, nor shall they affect any orders that have already been placed.
2.2 You agree not to use a virtual private network (VPN), proxy server, or any other technical means to circumvent, or assist others in circumventing, the geographic usage restrictions set forth in the preceding section.
2.3 If KKday discovers or reasonably suspects that you have violated Section 2.2, KKday may suspend or terminate your access to the AI Assistant without prior notice. You shall bear any legal risk or damages arising therefrom, and KKday shall not be liable therefor.
Article 3 Collection, Processing, and Use of Data
3.1 When you use the AI Assistant, KKday will collect, process, use, and transfer across borders the conversation content you enter in the AI Assistant and related necessary data in the manner described in the Privacy Policy.
3.2 Please avoid entering unnecessary personal data in the AI Assistant (including but not limited to other people's names, contact information, or identification document information).
3.3 To reduce the risk of your personal data being leaked, please avoid entering personally identifiable or sensitive information, such as passport numbers, credit card numbers, or health conditions, in the AI Assistant.
3.4 KKday will use the conversation content you enter in the AI Assistant to provide and operate the AI Assistant, ensure response quality, and detect and prevent abusive behavior, and, within the scope set forth in the Privacy Policy, to review, test, and improve the AI Assistant.
3.5 To provide the AI Assistant, KKday may transfer the conversation content you enter and necessary data to cloud service, large language model, or other technology service providers engaged by KKday (which may be located outside the Republic of China (Taiwan)) for processing. KKday will require such service providers to process your data in accordance with protection standards no less stringent than those set forth in these Terms and the Privacy Policy, to use it only to the extent necessary to provide the AI Assistant, and not to use it for their own purposes.
3.6 KKday will retain and use your conversation records in the AI Assistant for the period and in the manner set forth in the Privacy Policy. You may exercise your statutory rights regarding your personal data, including the rights to inquire, review, obtain copies, supplement or correct, request cessation of collection, processing, or use, and request deletion, in the manner set forth in the Privacy Policy.
Article 4 Boundaries Regarding Ordering
4.1 Any suggestions, itinerary plans, or responses generated by the AI Assistant do not constitute an instruction or commitment by KKday to order, change, or cancel any product.
4.2 If you wish to order, change, or cancel any product, you must still do so through the existing ordering process on the KKday website or App. Product information displayed by the AI Assistant (including but not limited to prices, availability, and promotions) may change at any time, and the actual transaction terms shall be those displayed on the page at the time the order is placed.
Article 5 Usage Guidelines
5.1 You understand and agree that the AI Assistant is powered by artificial intelligence technology and that you are not interacting with a human customer service agent. KKday will clearly inform you that you are interacting with AI when you first use the AI Assistant, and will continue to indicate this in an appropriate manner in the AI Assistant's chat interface so that you can recognize at all times that you are interacting with AI. You should independently evaluate and verify the accuracy of responses and should not rely on them without verification.
5.2 Artificial intelligence technology may produce information that is erroneous, incomplete, or outdated. For the following six categories of information, the AI Assistant will display a corresponding reminder below the response, and you should rely on official announcements from KKday, official authorities at the destination, or professional institutions (such as travel agencies, medical institutions, or insurance companies). Other information for which no reminder is displayed may also be erroneous, incomplete, or outdated, and you should still verify it yourself:
(a) Visa and entry requirements;
(b) Customs regulations;
(c) Tax refund rules;
(d) Weather information;
(e) Insurance-related information; and
(f) Medical-related information.
5.3 The AI Assistant generates suggestions and recommendations through large language model tools based on the conditions you enter (such as destination, number of days, budget, number of travelers, and requirements). The ranking logic of recommendations may vary due to technical adjustments, market strategies, or changes in suppliers.
5.4 Recommendations provided by the AI Assistant do not represent an endorsement or guarantee by KKday of any particular product, supplier, or merchant, or any commitment as to the priority of recommendations.
5.5 The AI Assistant does not replace human customer service. If you have any questions about the AI Assistant's responses, or need assistance with existing orders, refunds, returns, complaints, or other individual matters, please contact the KKday Customer Service Center (email: [email protected]).
5.6 The AI Assistant is not intended for emergencies, medical first aid, personal safety, or other situations requiring immediate action. In such situations, please immediately contact your local emergency rescue, medical, or law enforcement authorities, and do not rely on the AI Assistant's responses.
5.7 If you find that any response from the AI Assistant is erroneous, discriminatory, inappropriate, or infringes the rights of others, please report it to KKday. KKday will review the matter and take appropriate action within a reasonable period.
Article 6 Acceptable Use Policy
When using the AI Assistant, you shall not:
(a) Enter or transmit any unlawful, infringing, fraudulent, harassing, defamatory, or otherwise inappropriate content;
(b) Upload, enter, or transmit any content containing viruses, malware, or other harmful code;
(c) Attempt, through reverse engineering, decompilation, or other means, to obtain the source code or underlying technology of the models, algorithms, or systems used by the AI Assistant;
(d) Use automated programs, bots, or other technical means to extract the AI Assistant's responses in bulk or repeatedly;
(e) Use the AI Assistant's responses to train, develop, or optimize other artificial intelligence models or competing services;
(f) Circumvent, interfere with, or disrupt any safeguards or usage restrictions established by KKday for the AI Assistant (including but not limited to the geographic restrictions under Article 2);
(g) Enter or transmit the personal data of others without their consent;
(h) Use prompt injection or other means to intentionally circumvent or break the AI Assistant's safeguards, or induce the AI Assistant to generate output that violates laws, public order and good morals, or KKday policies; or
(i) Distribute the AI Assistant's responses in a manner that may cause others to mistake them for formal statements, commitments, or official information of KKday.
If your violation of this Article causes damage to KKday or any third party, or subjects KKday to any third-party claim, demand, lawsuit, or investigation by an administrative authority, you shall be liable for damages and shall reimburse KKday for the necessary expenses incurred as a result (including reasonable attorneys' fees).
Article 7 Third-Party Links
If the AI Assistant's responses contain links to third-party websites or resources, such websites or resources are operated by third parties other than KKday, and KKday assumes no responsibility for their content, privacy practices, or terms of use. We recommend that you read the relevant policies of such third parties before clicking on such links.
Article 8 Disclaimers and Limitation of Liability
8.1 KKday does not guarantee the accuracy, completeness, timeliness, or suitability of the content provided by the AI Assistant (including but not limited to itinerary suggestions and product recommendations).
8.2 To the maximum extent permitted by law, KKday shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use the AI Assistant. These Terms do not affect any non-excludable rights to which consumers are entitled by law.
8.3 KKday does not guarantee that the AI Assistant will operate continuously, without interruption, securely, or error-free. All or part of the AI Assistant may be temporarily unavailable due to system maintenance, version updates, third-party service interruptions, force majeure, or other causes not attributable to KKday, in which case KKday will use reasonable efforts to restore it as soon as possible.
8.4 Responses from the AI Assistant are for general reference only and do not constitute professional advice, including medical, legal, tax, financial, insurance, visa, or immigration advice, nor do they constitute a guarantee by KKday as to the suitability or safety of any travel arrangement. If you need advice on such matters, you should consult a suitably qualified professional or the competent authorities.
8.5 The disclaimers and limitations of liability set forth in this Article shall not apply in cases of KKday's willful misconduct or gross negligence, nor shall they affect your rights under the Consumer Protection Act and other mandatory provisions of law. Limitations of liability not provided for in these Terms shall be governed by the relevant provisions of the Terms and Conditions.
Article 9 Intellectual Property Rights and Content License
9.1 All copyrights, trademarks, and other intellectual property rights in the AI Assistant and its user interface, programs, models, algorithms, databases, prompt designs, and related documentation belong to KKday or its licensors. Except as expressly permitted by these Terms, you may not reproduce, adapt, distribute, publicly transmit, rent, sell, or otherwise use them.
9.2 You retain your existing rights in the text, images, or other content you enter in the AI Assistant (“Input Content”). For the purposes of providing, operating, reviewing, and improving the AI Assistant, you agree to grant KKday and its affiliates a worldwide, non-exclusive, royalty-free license, sublicensable to technology service providers engaged by KKday, to reproduce, store, process, transmit, and use your Input Content to the extent necessary. The scope of the foregoing license shall not exceed the purposes and periods set forth in these Terms and the Privacy Policy.
9.3 You warrant that you have lawful rights to your Input Content and that it does not infringe any third party's intellectual property rights, privacy rights, trade secrets, or other rights.
9.4 You understand and agree that the AI Assistant's responses are automatically generated by artificial intelligence through statistical methods and may not be protected by copyright law, and that other users entering the same or similar conditions may receive the same or similar responses. KKday does not guarantee the uniqueness or originality of responses, and you may not claim exclusive rights in any response against KKday or other users.
9.5 Provided that you comply with these Terms, KKday will not assert rights against your use of responses for personal, non-commercial travel planning purposes. Any commercial use (including but not limited to public distribution, resale, or use in for-profit services) requires KKday's separate prior written consent.
Article 10 Monitoring, Suspension, and Termination of Service
10.1 KKday may monitor the use of the AI Assistant (including but not limited to for quality monitoring and abuse prevention purposes) and may, based on business or operational considerations, adjust, suspend, or terminate all or part of the AI Assistant at any time. For reasonably foreseeable adjustments, suspensions, or terminations, KKday will provide notice in an appropriate manner before they take effect, except in urgent circumstances such as force majeure, information security incidents, or requirements of laws or competent authorities. KKday shall not be liable for any such adjustment, suspension, or termination; provided, however, that this shall not affect any non-excludable rights to which you are entitled by law, nor your rights in respect of orders already placed for KKday services other than the AI Assistant.
10.2 If KKday reasonably suspects that you have abused the AI Assistant, engaged in fraudulent conduct, or violated these Terms, KKday may suspend or terminate your access to the AI Assistant without prior notice.
Article 11 Amendments to These Terms
KKday may amend these Terms in response to changes in laws and regulations, technological developments, or operational needs. Amended Terms will be posted on the KKday website or App and will apply from the effective date stated in the announcement. If you continue to use the AI Assistant after an amendment, you will be deemed to have accepted the amended Terms. If you do not agree to the amended Terms, please stop using the AI Assistant immediately; ceasing to use the AI Assistant will not affect your right to continue using other KKday services under the Terms and Conditions.
Article 12 Governing Law and Jurisdiction
The interpretation and application of these Terms shall be governed by the laws of the Republic of China (Taiwan). In the event of any dispute arising from these Terms, both parties agree that the court of first instance for the place of business of the KKday contracting entity specified in Section 1.2 of the Terms and Conditions shall be the court of first instance with jurisdiction over any dispute or controversy arising from your use of KKday's services.

Article 14 Miscellaneous
14.1 If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable in whole or in part, the validity of the remaining provisions shall not be affected.
14.2 KKday's failure to exercise, or delay in exercising, any right under these Terms shall not constitute a waiver of such right.
14.3 The article numbers and headings in these Terms are for convenience of reading only and shall not affect the interpretation of these Terms.
14.4 Any version of these Terms in a language other than Traditional Chinese is provided for reference only. In the event of any discrepancy between versions, the Traditional Chinese version shall prevail.
14.5 The provisions of Articles 3, 6, 8, 9, and 12 of these Terms shall survive your cessation of use of the AI Assistant or the suspension or termination of your access.
