Order Agreement

The purchaser (hereinafter referred to as Party A) contacts KKday (hereinafter referred to as Party B) to purchase cabin tickets for the "MSC Bellissima" cruise ship or to book shore excursions and international cruise cabins (tickets). Given that the "Standardized Contract for Overseas Group (Individual) Travel," the "Standardized Contract for Overseas Cruise Travel," and the "Cruise Cabin Sales Agreement" do not apply to international cruise cabin bookings, and that the payment terms, cancellation, changes, and refund regulations for cabin bookings are strictly regulated, both parties agree to abide by this agreement on this product page.

I. Cruise Booking and Payment Methods

1. Party A shall pay Party B the full amount upon placing the order to ensure the rights and interests of both parties.
2. The cruise fare (cabin) includes: cabin accommodation, cruise transportation, meals at the designated main restaurant (buffet restaurant), port taxes, baggage handling, onboard entertainment and recreational facilities.
3. Unless otherwise agreed by both parties in accordance with the proviso, the following items are not included in the ticket price: personal medical expenses, shopping, service tips, personal expenses, alcoholic and non-alcoholic beverages, laundry fees, telephone fees, onboard WIFI, photo developing, SPA, beauty treatments, optional paid restaurants, optional shore excursions, paid beverages provided in the cabin, and other services that require payment. It is recommended that Party A purchase travel insurance at its own expense.
4. According to regulations, it is not necessary to send a tour leader when purchasing international cruise tickets.

II. The 【MSC Glory Booking Agreement】is subject to extremely strict regulations regarding payment terms, cancellations, changes, and refunds when booking international cruise ship seats. Regarding cruise itinerary booking changes, cancellations, and penalties:

1. If Party A (the traveler) cancels the main contract (hereinafter referred to as "cancellation") before the start of the tour, the relevant provisions regarding the liability for cancellation shall apply.
a. If Party A terminates the contract before the cruise ship departs, Party A shall pay the administrative fees as per the receipt provided by Party B, and shall compensate Party B for its losses, based on the following:
i. For those who cancel their contracts 90 days or more before the departure date, a cancellation fee of NT$15,000 per person will be paid.
ii. If the contract is cancelled between the 89th and 60th day prior to departure, the party shall compensate for 40% of the full cabin cost.
iii. If the contract is cancelled within 59 to 32 days prior to departure, the party shall compensate 60% of the full cabin cost.
iv. If the contract is cancelled between the thirty-first and sixteenth day prior to departure, the party shall compensate 80% of the full cabin cost.
v. Anyone who cancels the contract within fifteen days prior to departure, or fails to report without prior notice, shall compensate 100% of the full cabin cost.

2. When calculating compensation in the above manner, if the compensation amount is less than NT$15,000 per person, the compensation will be calculated based on the full cabin fare.
3. If Party A changes or cancels its reservation, it shall notify Party B in writing, specifying the date and details. Notifications made by telephone or verbally shall be deemed invalid. Furthermore, if the reservation falls on a domestic or international public holiday, Party A shall notify Party B in advance on the working day before the holiday to comply with the international cruise company's regulations on calculating operations based on the lunar calendar.


III. Cruise Ship Cabin Login List Regulations

1. Cabin registration list, allocation, and related change regulations:
a. At least 50 days prior to departure, Party A shall provide Party B with a complete and accurate list (same as the English names on the passports) (including: Chinese and English names as on the passports/gender/ID number/nationality/passport validity and number, and cabin allocation details. Passports must be valid for at least 181 days from the date of disembarkation).
b. If Party A wishes to change the passenger list or cabin allocation 49 to 31 days before departure, Party A shall pay Party B a handling fee of NT$3,000 per person.
c. No name or cabin assignment can be changed within 30 days prior to departure.

2. If Party A holds dual passports (passports from more than one country), the cruise company requires that the name registered on board must match the name on the passport held at the time of boarding. Party A should bring both passports and handle the necessary visas themselves. If Party A boards and leaves the country with a passport other than that of the Republic of China, Party A should apply for a visa to re-enter Taiwan on their own.

3. Party A shall submit its passport information and the necessary visa information for the voyage to Party B more than 50 days before departure, so as to facilitate the registration of information with the cruise company.
4. According to the cruise company's regulations: infants under 6 months old and women who are more than 24 weeks pregnant during the trip are not allowed to board the ship; those under 18 years of age are not allowed to register for the cruise alone; each cabin must have at least one passenger aged 21 or above.
5. Pregnant women under 24 weeks of pregnancy must present a doctor's certificate proving they are fit to travel on the ship. Pregnant women 24 weeks or more of pregnancy are not allowed to board the ship (no doctor's certificate or waiver will be accepted for boarding).
6. If Party A fails to provide the correct passport, visa information, and cabin allocation within the aforementioned period, resulting in the inability to board the ship smoothly, Party A shall be solely responsible, and the cruise company and Party B shall bear no responsibility.
7. Party A acknowledges that Party B is acting as an agent for selling cruise ship cabins. Party A shall prepare all relevant licenses and permits on its own. If Party A entrusts Party B to handle visas, Party A shall prepare such work in advance. Party A shall be solely responsible for any related liabilities arising from overdue processing or failure to complete the visas in a timely manner.
8. Passports and other original documents will not be accepted for this itinerary. Passengers are required to check the condition of their passports and inform other passengers traveling with them to bring them for boarding procedures. In addition, according to the cruise company's regulations, passports must be valid for more than 180 days (calculated from the date of boarding).

IV. Issues of Responsibility

1. When purchasing international cruise tickets, original passports and other documents will not be accepted. Party A must check the validity period and number of valid pages of the passport and inform fellow passengers to bring valid documents to facilitate boarding procedures. Party A may not raise any objection on the grounds of ignorance or failure to sign an agreement.
2. Passengers must abide by the laws of each country and hold a valid passport and visa as required. The shipowner shall not be held responsible if a passenger is refused entry or boarding by a country due to personal reasons or visa/passport issues.
3. If Party A is refused entry or boarding due to its own problems or reasons not attributable to Party B, its cabin fee will not be refunded. Any resulting expenses, such as transportation and accommodation, shall be borne by Party A and shall not be the responsibility of Party B.
4. If Party A is a dual citizen, a foreign citizen, or otherwise required by household registration regulations, Party A shall be solely responsible for verifying its entry and exit documents, and Party B shall not be held liable.
5. Party B's sole responsibility is to book designated cruise cabins or shore excursions on behalf of Party A. Therefore, all services and related rights (including but not limited to voyage, port of call notices, onboard meals, facility usage, entertainment activities, and matters related to booking cancellation and compensation) shall be provided and handled by the cruise company.
6. Due to force majeure or for reasons such as passenger safety or government orders, the cruise company may make necessary changes to the boarding, arrival/departure times, and ports of call without prior notice. In the event of such changes, neither Party B nor the cruise company shall be liable to Party A for any refunds or compensation. Both parties agree to comply with the cruise company's relevant announcements and regulations. If Party A disagrees with the cruise company's response and cancels the departure, unless otherwise agreed, Party A shall still pay all fees under this agreement, and Party B shall have no obligation to refund any fees.

V. Other Precautions

1. Before departure, Party A (passengers) should consider whether to purchase travel accident insurance, overseas emergency medical insurance, and related insurance for cruise cancellation and delay from an insurance company, and understand the claims standards from the insurance company to share the related expenses arising from accidents and injuries, as well as the uncertain risks during the actual cruise voyage.
2. The age restrictions for participants, check-in regulations, and daily cabin service fees are subject to the regulations of the cruise company. Please refer to the brochures or the cruise company's official website for detailed regulations.
3. The calculation basis for the pregnant woman's boarding period is based on the cruise company's regulations, and it shall not exceed 24 weeks (calculated backward from the date of boarding) (no doctor's certificate or waiver will be accepted for boarding application), and the pregnant woman must take the initiative to present a "certificate of seaworthiness" issued by a doctor before boarding.
4. Infants must be more than 6 months old to be eligible to board the ship (calculated backwards from the date of boarding).
5. Passengers with disabilities must be able to take care of themselves or be accompanied and cared for by another passenger who can provide all assistance throughout the trip. They must bring their own medications so that necessary help can be provided when needed.
6. Passengers with special medical conditions, diabetes, chronic diseases, or those who need to take medication/injections regularly should inform the company before registration (subject to the cruise company's regulations). If necessary, the passenger must provide a "certificate of seaworthiness" issued by a doctor. The cruise company reserves the right to decide whether to allow boarding. Passengers carrying special/controlled medications are advised to prepare a doctor's prescription or supporting documents for use if necessary.
7. If the above precautions are not followed and boarding is not possible, a cancellation fee will be charged in accordance with the cancellation provisions of this contract.
8. The rights and regulations of Party A regarding the booking of cruise cabins and the relevant provisions shall be subject to the cruise company's announcements, boarding instructions and contract stipulations.
9. Party A (passengers) shall comply with the relevant epidemic prevention measures of the cruise company, the territorial sea country, the country of arrival, and our country.
10. Any medical treatment or medical care shall be handled in accordance with the regulations of the cruise company and the local government of the host country. However, the cruise company shall be solely responsible for all expenses incurred due to illness, including but not limited to quarantine, accommodation, transportation, meals, translation services, and medical care.

VI. Other Agreed Matters

1. All advertisements, attachments, promotional materials, pre-departure briefings, pre-departure brochures, and other related documents relating to this Agreement are part of this Agreement and have the effect of supplementing this Agreement.
2. Party A shall, before departure, consider purchasing relevant travel accident insurance and inconvenience insurance, and understand the insurance company's claims standards in order to share the risks.
3. In the event of force majeure or for reasons such as passenger safety, government orders, or technical malfunctions, the cruise company may, without prior notice to passengers, and the captain, under his command, make necessary changes to the boarding arrival/departure times and ports of call during the itinerary. In the event of such changes, the cruise company and Party B shall not be liable for any refunds or compensation. Any resulting losses, such as delays or cancellations of booked land hotels or sightseeing tours, reductions in onboard and land stays, or disruptions to airfares or other transportation, shall be borne by Party A and shall not be covered by Party B or the cruise company. If Party A disagrees with the cruise company's response and cancels the departure, unless otherwise agreed, Party A shall still pay all fees under this agreement, and Party B shall not provide a refund.
4. If any provision of this Agreement requires the cooperation of Party A to be fulfilled, and Party A fails to do so, Party B may set a reasonable period for Party A to urge Party A to fulfill the obligation. If Party A fails to do so within the stipulated period, Party B may terminate this Agreement and seek compensation from Party A in accordance with Article 2 of this Agreement.
5. If Party A leaves the ship midway for any reason, or is late, or fails to complete the entire voyage due to its own fault, Party A shall not request Party B to refund any fees.
6. Party A shall always take care of its own safety and the safekeeping of its property. If Party A suffers bodily or property damage due to reasons not attributable to Party B or the cruise company, Party A shall bear all related expenses.
7. During the voyage, if Party A suffers damages while traveling on public transportation such as cruise ships, subways, buses, or airplanes due to reasons not attributable to Party B, the respective service providers shall be directly liable to Party A. However, Party B shall exercise the care of a good manager to assist Party A in handling such matters.
8. Party A agrees that Party B may, in accordance with the law, collect, process, transmit, and use Party A's personal data for the purpose of booking cruise ships and services attached to this Agreement, as required by this Contract. Party A also agrees that Party B may, within the scope of the purpose of this Contract, provide Party A's personal data to the cruise company for operational processing and use. Party A may exercise the rights to inquire about, request to view, make copies of, supplement or correct, request to stop the collection, processing or use, and request deletion of Party A's personal data.
9. If Party A is the majority party, it has authorized its agent to review the matters contained in this Agreement, and the purchase constitutes acceptance of the terms contained in this Agreement.
10. In the event of any litigation arising out of or in connection with this Agreement, both parties agree that the Taipei District Court of Taiwan shall be the court of first instance.

  • Pregnant women: Pregnant passengers must proactively disclose their gestational age and number of fetuses, and carry a doctor's certificate of fitness to travel. Mediterranean cruise ships will refuse boarding to pregnant women who will enter their 24th week of pregnancy before the end of the voyage. Please be sure to inform us at the time of registration. If the voyage is affected due to a passenger's concealment of their pregnancy or physical/mental condition, the cruise company reserves the right to pursue legal action for any resulting costs.
